Real Life Story of Disparate Impact and Pregnancy Discrimination

Rita, X-Ray Technician-Kingsville, TX

An x-ray technician was forced to take extended leave when she informed her employer that she was pregnant. The hospital claimed that they were concerned about the fetus' exposure to the x-rays and a potential future tort suit. The court ruled that this was a mere cover up for discrimination because there was an available alternative that was less discriminatory and the hospital failed to implement it.

Zuniga v. Kleberg County Hospital, 692 F.2d 986 (5th Cir. 1982)
